On Wednesday, the Justice Department filed a response countering the appeal of Boulder County, Colorado officials who are claiming the Religious Land Use and Institutionalized Persons Act (RLUIPA) is unconstitutional. The DOJ agreed with the Rocky Mountain Christian Church, which earlier this year won a legal battle to expand its campus after county commissioners rejected their request. Citing RLUIPA, the church successfully convinced a jury and a judge that its rights were violated in that denial a ruling being challenged by the County in its appeal. The Justice Department is apparently unimpressed:

Despite Boulder County’s argument that land-use provisions in the federal Religious Land Use and Institutionalized Persons Act are unconstitutional, the county’s appeal doesn’t “offer any serious argument” of that, according to the Department of Justice filing in the lawsuit between the church and Boulder County Commissioners.
