Before we get caught up in the upcoming confirmation hearings for Judge Sotomayor – that should heat up in a couple of weeks – Justice Souter's strong record on church-state issues deserves a look back. Baptist Joint Committee Director Brent Walker offers just that in the new issue of Report From the Capital.

Justice Souter will be difficult to replace when it comes to church and state. More than any other justice, he has reflected the BJC’s understanding of the proper interpretation of the religion clauses and how they apply to contemporary church-state issues. During his tenure, he has been an intellectual force arguing for a muscular understanding of the two clauses, but applying them in a way that respects precedent and judicial restraint.
