There Judge Janice Rogers Brown's opinion determined that Michael Newdow did not have standing to bring an Establishment Clause challenge to religious elements in President Obama's Inauguration ceremony. A concurring opinion by Judge Brett Kavanaugh would rule against Newdow's argument but allow him to bring the suit.
