A federal judge this week refused to lift a ban on a nativity scene display in the median of a heavily trafficked road in Warren. The Plaintiff, John Satawa, argues that the Macomb County Commission's refusal of his display amounts to an unconstitutional hostility to religion. But Judge Gerald Rosen agreed with the city that traffic safety concerns allowed the restriction of the area as a public forum, and ruled that the separation of church and state does not require the Commission to accept the religious scene on public ground.
