Via Religion Clause, a Minnesota judge has denied a request by the controversial TiZA Islamic charter school to throw out a suit alleging the tax-funded institution improperly promotes religion, in violation of the separation of church and state. The ACLU's claim against the school can proceed, both against the school and against several officials who – the Judge Donovan Frank ruled – are not granted qualified immunity. Frank also ruled against a group of students seeking to intervene, citing the speculative nature of their claim of injury and the fact that the deadline for adding parties to the suit had passed.
