The Supreme Court ordered yesterday that the Solicitor General may participate in the upcoming hearing in Arizona Christian School Organization v. Winn, involving a challenge to Arizona's tuition tax credit program due to its heavy funding of religious schools. That case is scheduled to be heard November 3.

Also, the court declined to hear the case Association of Christian Schools v. Stearns, a challenge to the California University system's refusal to accept certain credits from religious schools in evaluating admission applications. The Supreme Court's decision not to hear the case leaves in place the 9th Circuit's ruling that the state's criteria are allowed and do not amount to unconstitutional religious discrimination.
